By downloading, installing, accessing, and using the WeeknightChef mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

WeeknightChef ("we," "us," "our," "Company," or "Service Provider") reserves the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the App following any changes constitutes your acceptance of the new Terms.

2. Eligibility

2.1 Age Requirements

You must be at least 13 years old to use WeeknightChef. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into binding contracts
• Your use of the App is in compliance with all applicable laws

2.2 Account Registration

If you create an account:

• You agree to provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are liable for all activities that occur under your account
• You agree to notify us immediately of any unauthorized access

3. License and Use

3.1 Limited License

We grant you a non-exclusive, non-transferable, revocable license to:

• Download the App on compatible devices
• Use the App for personal, non-commercial purposes
• Access recipes, meal planning, and grocery list features

3.2 Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App or its content
• Reverse engineer, decompile, or disassemble the App
• Sublicense, sell, rent, lease, or lend the App
• Remove or alter any notices, labels, or proprietary marks
• Use the App for any unlawful purpose or illegal activity
• Attempt to gain unauthorized access to our systems
• Upload malware, viruses, or harmful code
• Spam, harass, or abuse other users
• Interfere with the normal operation of the App

3.3 Intellectual Property

All content in the App including:

• Software code
• Design elements
• User interface
• Icons and graphics
• Trademarks and logos

...is the intellectual property of WeeknightChef or our licensors. You may not use any of this content without our prior written consent.

4. User Content

4.1 Your Content

You retain ownership of any content you create within the App, including:

• Recipes you create
• Modifications to recipes
• Meal plans
• Grocery lists
• Notes and annotations
• Uploaded photos

4.2 License to WeeknightChef

By creating content in the App, you grant us a non-exclusive, royalty-free, perpetual license to:

• Store your content on our servers
• Display your content to you
• Use your content to provide and improve our services
• Analyze your content to improve recommendations (anonymized)

4.3 AI-Generated Content

• Recipes generated by AI remain your property
• AI-generated images are yours to use
• You may save, share, or modify AI-generated content
• We retain the right to use anonymized recipes for service improvement

4.4 Prohibited Content

You agree not to upload or create content that:

• Infringes on others' intellectual property rights
• Contains illegal instructions or dangerous content
• Is sexually explicit or obscene
• Harasses, defames, or threatens others
• Contains personal identifying information of others (without consent)
• Is spam or promotional content
• Violates any applicable laws

5. AI and AI-Generated Content

5.1 How AI Works

WeeknightChef uses artificial intelligence (OpenAI's GPT-4o-mini) to:

• Generate personalized recipes based on your preferences
• Modify recipes according to your requests
• Generate descriptions and nutritional estimates
• Create AI images of recipes

5.2 Accuracy Disclaimer

AI-generated recipes and nutrition information:

• Are approximations, not guaranteed to be 100% accurate
• Should be verified before using for dietary/medical purposes
• May contain occasional errors or inconsistencies
• Are not substitutes for professional nutritionist advice

5.3 Limitations

• AI may sometimes generate recipes that don't match your requests
• Nutritional data is estimated and may vary from actual values
• Generated images may not match descriptions perfectly
• AI has knowledge cutoff dates and may not reflect latest culinary trends

5.4 Your Responsibility

You are responsible for:

• Verifying recipes are appropriate for your dietary needs
• Checking ingredients for allergies or preferences
• Consulting professionals for medical/dietary concerns
• Using common sense when preparing recipes

6. Third-Party Services

6.1 Third-Party Integrations

WeeknightChef integrates with:

• Supabase - Cloud database and authentication
• OpenAI - AI recipe generation
• Replicate - AI image generation

6.2 Third-Party Terms

Your use of these services is governed by their own Terms of Service and Privacy Policies:

7. Payment Terms (If Applicable)

7.1 Free Tier

WeeknightChef offers free access to:

• System recipes (375 pre-made recipes)
• Weekly meal planning
• Grocery list management
• Guest mode usage

7.2 Future Premium Features

If we offer premium features in the future:

• Prices are subject to change with 30 days' notice
• Subscriptions will automatically renew unless canceled
• You may cancel at any time in app settings
• Refunds follow App Store policies (Apple/Google)
• We are not responsible for App Store billing issues

7.3 Payment Processing

Payments are processed by:

• Apple (for iOS in-app purchases)
• Google (for Android in-app purchases)

We do not directly process, store, or have access to your payment card information.

8. Warranties and Disclaimers

8.1 "AS IS" Provision

WeeknightChef is provided "AS IS" without warranties of any kind, expressed or implied.

8.2 No Warranties

We do not warrant that:

• The App will be error-free
• The App will be uninterrupted
• The App will meet your expectations
• Recipes will always work perfectly
• Nutritional data will be 100% accurate
• AI-generated content will always be appropriate
• Third-party services will be available

8.3 Your Responsibility

You use the App at your own risk. You are responsible for:

• Verifying recipe accuracy
• Checking for allergens
• Using proper food safety practices
• Consulting professionals for medical advice
• Ensuring your device has adequate storage

9. Limitation of Liability

9.1 No Liability For

To the fullest extent permitted by law, we are not liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Damages from food poisoning or health issues
• Costs of substitute products or services
• Damages from your use of recipes or AI-generated content
• Damages from third-party services
• Any damages resulting from your use of the App

9.2 Liability Cap

Our total liability shall not exceed the amount you paid us in the past 12 months (or $0 if you use the free tier).

9.3 Disclaimer

Some jurisdictions do not allow limitations of liability. In those cases, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless WeeknightChef from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of the App
• Your content or recipes
• Your use of AI-generated content
• Your violation of any laws or regulations
• Your infringement of others' rights

You agree not to:

• Interfere with server operations
• Reverse engineer or decompile the App
• Bypass security measures

11.4 Commercial Violations

• Resell or redistribute the App
• Use the App for commercial purposes without permission
• Scrape data from the App
• Create competing products using our data

12. Account Termination

12.1 We May Terminate If:

• You violate these Terms
• You engage in illegal activity
• You abuse the service or other users
• We cease operations
• As required by law

12.2 Your Termination

• You can delete your account at any time
• All your data will be immediately deleted
• This action cannot be undone

12.3 Effects of Termination

• Your license to use the App terminates
• Your account and data are deleted
• Provisions about your content, indemnification, and liability survive termination

• Any applicable terms from Apple/Google

The App is not intended for users under 13. We comply with COPPA (Children's Online Privacy Protection Act).

The App may be subject to export control laws. You agree not to:

• Export the App to prohibited countries
• Export to users on government restricted lists
• Use the App for prohibited end-uses (weapons, nuclear, missiles)

18. Severability

If any part of these Terms is found to be unenforceable:

• The remaining Terms continue in effect
• To the greatest extent possible, the unenforceable provision will be modified to be enforceable

19. Entire Agreement

These Terms constitute the entire agreement between you and WeeknightChef regarding use of the App and supersede all prior agreements.

These Terms are governed by and construed in accordance with the laws of:

• The State of California, USA (or your jurisdiction if prohibited)
• You consent to the exclusive jurisdiction of courts in that location

21. Dispute Resolution

Before pursuing legal action, try to resolve disputes by:

3. Allowing 30 days for response

21.2 Arbitration (If Applicable)

21.3 Class Action Waiver

You agree not to participate in class action lawsuits against WeeknightChef.

22. Limitation on Time to File Claims

Any claim or action regarding these Terms must be filed within:

• 1 year from the date the claim arises
• Claims filed after this period are barred
